“人肉搜索”视角下隐私权保护的法律规制

On Privacy Protection Law From the Perspective of “Cyber Manhunt”

当今,网络“人肉搜索”参与者数量众多且具有不确定性,网友之间相互转发、评论、补充,通常在十几分钟或者是更短的时间内就可以准确地收集到搜索目标的个人信息。由于“人肉搜索”可能直接涉及到个人信息的泄露,其常常与网络暴力、侵权、个人信息曝光等联系在一起,情节严重的还有可能承担刑事责任。因此,有必要对其进行法律规制。

Presently,there are many people who take part in“cyber manhunt”,which causes great uncertainty.Individual’s personal information may be revealed in 10 minutes or even shorter period by changing information among friends via network.Since“cyber manhunt”may lead to the disclosure of personal information,it is usually related to online violence,infringement,and information disclosure.In some severe cases,there might be criminal responsibility.Therefore,related laws and regulations should be developed.
