集体自治规则化探讨与展望

摘要 劳动立法是经济之法也是改革之法,其构建于经济变革基础之上.为适应市场经济基础的确立,促进经济社会的改革发展,构建和谐劳动关系和共治共享的社会治理格局,我国的劳动立法选择了集体自治的方式,通过集体自治的方式权衡企业管理自由和劳动者权益保障,推动实现公平与效率兼顾的法治目标和共享与民主的政治目标.目前,我国的劳动立法存在着制度易被变通﹑ 企业管理自由难以保障﹑劳动关系司法保护不稳定等问题.为了完善制度,需要明确集体自治的法律属性,实现集体协商的规则化,明确集体自治理论基础,构建集体行为效力的法律支撑. Labor legislation is the law of economy as well as the law of reform, which is built on the basis of economic change. In order to adapt to the establishment of market economy foundation, promote the reform and development of economy and society, and construct a harmonious labor relationship and a social governance pattern of co - governance and sharing, China ' s labor legislation has chosen the way of collective autonomy, balancing the freedom of enterprise management and the protection of workers ' rights and interests through collective autonomy, and promoting the realization of fairness and efficiency. Consideration of the rule of law objectives and the political objectives of sharing and democracy. At present,China ' s labor legislation has many problems,such as flexible system,difficult to guarantee the freedom of enterprise management, unstable judicial protection of labor relations and so on. In order to improve the system, we need to clarify the legal attributes of collective autonomy, realize the regularization of collective consultation, clarify the theoretical basis of collective autonomy, and construct the legal support of the effectiveness of collective action.
