论国际投资条约的可持续发展转变及其困境

Analysis on the Transformation of the Sustainable Development of International Investment Treaty and Its Dilemma

可持续发展理念的深入发展对国际投资条约产生了深远的影响,包括增加环境劳工条款、重新界定公平公正待遇与间接征收条款的范围、限制投资者与东道国争端解决机制的启动以及提升企业的社会责任感。部分国家和国际组织在国内和/或国际层面进行了实践,一方面是由于国际投资条约本身形式的转变,另一方面是基于国际投资基本理念的变化。但对于实现可持续发展具体投资条款的内容,国际社会尚未达成一致,甚至争议激烈,传统国际投资条约依然主导国际投资发展。中国作为由商品输出到资本输出转变的大国以及"一带一路"倡议下的投资国,需要在国际投资条约中就中国的利益提出具体的要求,支持可持续发展转变的基本理念,并持续关注国际投资条约具体条款的可持续发展转变。

The further development of the concept of sustainable development has a profound impact on the international investment treaties,which include increasing the clauses about labor and environment,redefining the scope of fair and equitable treatment clause as well as indirect expropriation clause,limiting investor-state dispute settlement mechanism,promoting the sense of social responsibility of enterprises.Some countries and international organizations have practiced at the domestic and/or international level,which is not only due to the changes on the form of international investment treaties themselves but also because of the changes on the concepts of international investment.But for the content of specific investment provisions for sustainable development,the international community has yet to reach agreement.Traditional international investment treaties still dominate international investment development.As the leading power on the transformation of commodity output to capital output and the investment country under The Belt and Road Initiative,China has better to make a request on how to realize its own benefits.It is necessary to support the basic concepts of sustainable development and continue to focus on the sustainable development of specific provisions of international investment treaties.
