我国农村环境污染问题立法研究

Research on the Legislation of Rural Environmental Pollution in China

目前我国农村整体环境不容乐观,作为农村环境主要污染源的工业污染源、农业污染源和生活污染源没有得到有效的遏制,而法律层面对农村环境问题还没有一部针对农村问题的法律,目前的环境保护法是以城市环境为重点制定的,且缺乏操作性和全面性。据此,从加强农村环境保护立法、提升立法针对性、增加激励性规定等三个方面探究并提出解决策略。

At present, the overall rural environment in China is not optimistic. As the main pollution sources of rural environment, industrial pollution sources, agricultural pollution sources and domestic pollution sources have not been effectively contained. At the legal level, there is no law for rural environmental problems. The current environmental protection law focuses on the urban environment, and lack of Operability and comprehensiveness. Based on this, This paper explores and puts forward solutions from three aspects: strengthening the legislation of rural environmental protection, improving the pertinence of legislation and increasing incentive provisions.
