最接近的现有技术是判断发明是否具有突出的实质性特点的基础。因此,结合案例指出确定最接近的现有技术应从与要求保护的发明的技术领域、所述解决的技术问题、技术效果、用途接近程度、公开技术特征的多少以及是否利于创造性评价等多方面进行考虑,从而客观、准确地判断是否具备创造性。

The closest prior art is the basis for judging whether the invention has outstanding substantive features. The closest prior art should be considered from the aspects or the technical field,the technical problem to be solved, the technical effect,the degree of application proximity,and the number of disclosed technical features of the invention were pointed out,especially the similarities and differences in the technical field between the existing technology and the invention.
