乡村治理中村规民约的困境与出路

Predicament and Countermeasure of Village Regulations and Agreements in Rural Governance

在乡村振兴的背景下,村规民约日益成为构建新时代乡村社会治理体系的关键性因素。村规民约来源于传统中国文化,已经被我国的法律政策所明确,且对乡村社会的综合治理作用巨大。但是,部分村规民约也存在规约内容违反法律、制定程序不规范和实施不顺畅等问题,严重制约了村规民约效能的发挥。有必要通过一系列的政策和手段对村规民约进行引导、提炼与完善,更新和调适其内容、规范其制定程序、保障其实施,真正发挥其在社会治理中的价值与作用。

Under the background of the rural revitalization,village regulations and agreements have become an indispensable key element to achieve effective rural governance. Village regulations and agreements embody the essence of the traditional Chinese culture,flexibility and adaptability. However,village regulations and agreements have their own limitations and are facing severe difficulties. Some village regulations and agreements do not fit the need of rural governance,or the procedure of develop is undemocratic,moreover,or have been not legally enforceable. Therefore it is necessary to solving the difficulties to ensure the legal framework for village regulations and agreements is to operate in a way which promote the modernization of the means of rural governance.
