专利当然许可制度研究——兼评我国《专利法修正案(草案)》

Research on the License Right System ——Comment on Amendment to the Patent Law (Drafts)

目前我国专利的实施与运用率较低,为此,2019年我国《专利法修正案(草案)》(征求意见稿)引入了专利当然许可制度,以期解决我国专利运用中出现的问题。域外的一些国家,如英国、法国、德国、巴西等国家都已经规定了当然许可制度,并形成了相对成熟的机制体系,这些国家为我国引入该制度提供了重要的参考依据。我国在构建当然许可制度时,需要解决好专利权属状态、当然许可使用费、专利年费优惠、当然许可的撤回、纠纷解决机制五个方面的问题,以提高该制度的适用效率。

At present,the patent implementation and operation rate in China is low.In order to solve China’s patent application problems,The Draft Amendment to China’s Patent Law(Drafts for comments)introduces the right license system.Some countries,such as Britain,France,Germany and Brazil have already stipulated the right license and formed a relatively mature mechanism system,providing an important referential basis for China’s system introduction.While constructing an effective and efficient license right system,China must solve problems in five areas,including patent ownership status,license fee,patent annual fee discount,license right withdrawal and dispute resolution mechanism.
