我国体育地方性法规与中央立法重复及防治研究

Duplication and Prevention of Local Sports Laws and Central Legislation in China

体育地方性法规重复中央立法是目前影响我国体育法规发挥实效的关键问题,也是我国体育法规体系科学化必须解决的难点问题。采用文献资料法、逻辑分析法等研究方法对我国体育地方性法规重复中央立法的现状与危害、产生此种法律现象的原因进行研究。认为体育地方性法规重复中央立法目前在我国是一种普遍的体育法律现象。此种法律现象虽然在历史上对体育法制发展有过推动作用,但目前对体育立法、体育法律关系相关主体及公民体育法治信仰都产生消极影响,是我国体育法制科学化必须解决的问题。体育地方性法规重复中央立法现象的出现有立法理念、立法机构、立法技术及立法评估等方面的原因。据此,从谨慎、创新、科学、完善4个层面对防治体育地方性法规重复中央立法提出了具体建议和对策。

The duplication of central legislation in local sports laws is the key issue that affects the effectiveness of sports laws and regulations in China,and is also a difficult problem that must be solved in the scientific system of sports laws and regulations.Adopting literature and logical analysis,this paper studies the present situation and harm of repeated central legislation of local sports laws and regulations,and the causes of this phenomenon of conflict of laws.It is held that the duplication of local sports laws and regulations is a serious and popular phenomenon.Although this kind of legal phenomenon has promoted the development of sports legal system in history,it has a positive effect on sports legislation,sports legal relationship and the public.The belief in the rule of law in civil sports has a negative impact,which must be solved.The phenomenon of repeated central legislation in local sports laws and regulations is caused by legislative idea,legislative organization,legislative technique and legislative evaluation and so on.On the basis of this,concrete suggestions and countermeasures are put forward to prevent and avoid the repeated legislation of local sports laws and regulations from the aspects of caution,innovation,science and system.
