比较法视角下的我国《体育法》修改研究——基于30国体育法的文本分析

A Study of the Revision of China’ Sports Law from the Perspective of Comparative Law——Based on 30 Countries’ Sport Laws

中国进入特色社会主义新时代后,体育法治建设成为一项紧迫而重大的任务。新时代中国体育事业的发展、全面深化体育改革的推进都需要一部符合新时代要求的《体育法》提供法治保障。通常而言,在立法和法律修改过程中,从国家法层面出发,对各国立法进行比较法学的研究是至关重要的一项工作。研究从比较法视角出发,对30个国家的体育法文本进行系统分析,旨在通过比较法研究,结合中国体育事业发展的具体国情探讨我国《体育法》的修改。研究认为,从比较法视角和中国体育发展的国情来看,《体育法》的修改应该从体育价值定位、关键性概念界定、公民体育权利的确认与保障、体育行政机构的权责法定、体育社会组织的权责法定、体育纠纷解决机制建立、体育国际交往、体育产业、反兴奋剂、学校体育、运动员权益等11个方面进行全面的完善和提升。

The 19th Congress of the Communist Party of China declares that China has entered a new era of socialism,which means that the socialism with Chinese characteristics,including Chinese sports and the rule of law,will enter a new development journey.The new era,the new sports and the new rule of law call for a new Chinese Sports Law.The revision of Chinese Sports Law has become a major task after entering a new era.In the new era,the development of China’s sports undertakings and the promotion of China’s comprehensive deepening of sports reform need a Sports law that meets the requirements of the new era to provide legal protection.It is very important to study the comparative law of national legislation from the perspective of national law.This article uses the comparative methods to make a systematic study of the Sports laws in 30 countries,aiming to explore how to amend Chinese Sports Law.The research shows that Chinese Sports Law should be improved and promoted from 11 aspects,such as,the orientation of sports value,the definition of key concepts,the confirmation and guarantee of citizens’ sports rights,the statutory powers and responsibilities of sports administrative organs,the statutory powers and responsibilities of sports social organizations,the establishment of sports dispute resolution mechanism,international sports exchanges,sports industry,anti-doping,school sports and athletes’ rights.
