Reestablishment of China’s Green Patent Fast Tracking System in the New Era

绿色专利快速审查制度通过加快绿色技术的专利授权而延长绿色专利权的生效时间,对绿色技术创新与应用推广具有正向激励作用。《专利优先审查管理办法》的实施使我国绿色专利快速审查制度从虚设回到几无。面对问题重重的现实,从合法性与合理性的视角分析了绿色专利快速审查制度重新确立的基本依据,并运用实证分析与比较研究的方法考察了其他国家绿色专利快速审查制度取得的成效与运行存在的问题,发现制度设立的差异产生了截然不同的绿色专利创造激励效果。建议我国构建与世界"和而不同"的绿色专利快速审查制度,分三步走建立"不同"的新时代中国特色绿色专利快速审查制度,进而与世界相"和"。

The green patent fast tracking system extends the protection time of green patent right by accelerating the patent authorization of green technologies, which has a positive incentive effect on green technology innovation and application promotion. The implementation of the "Patent Priority Examination Management Measures" has weakened China’s green patent fast tracking system. Faced with the many problems, this paper analyzes the basic foundation for the reestablishment of the green patent fast tracking system in China from the perspective of legitimacy and rationality. Besides, it examines the effects of green patent fast tracking system in other countries with empirical analysis. It is found that different systems have distinct incentive effects on green patent right. Moreover, it analyzes the univeral problem of green patent fast tracking system in the world from the perspective of comparative analysis. It is proposed that China should establish a green patent fast tracking system of "harmony in diversity" along with the world, and construct a "different" new-era green patent fast tracking system with Chinese characteristics in three steps, and then try to be "harmonious" with the world.
