The Globalization of Law from the Perspective of the Belt and Road:the Nature,Path and Trend

"一带一路"倡议为法律全球化注入新的内涵和动力,法律全球化的属性、路径与趋势在新形势下需要重新加以诠释。相较于美国"法律与发展运动","一带一路"影响下的法律全球化是自由主义的古典法律思想与团体主义的社会法思想的结合,它延伸、扩展第三次法律全球化的内涵与外延。"一带一路"推动下的法律全球化,既要坚持原有的功能主义进路,以现实法律问题为导向,也要开拓意义之维,从内部视角坚持多元主义。在全球化与地方主义的交互作用下,法律全球化将呈现出跨国法治、全球化下的地方法律、全球法律的地方化、世界主义和人类共同遗产四种发展趋势。

The initiative of the Belt and Road has injected new connotation and impetus into legal globalization;and the nature,path and trend of legal globalization need to be reinterpreted under the new situations.Compared with "the law and development movement" of the United States,the legal globalization under the influence of the Belt and Road will be the extension of the third legal globalization and the combination of liberal classical legal thoughts and collectivist social law thoughts.The globalization of law under the promotion of the Belt and Road should not only adhere to the original functionalism approach guided by practical legal issues,but also explore the dimension of meaning and adhere to pluralism from the internal perspective.Under the interaction of globalization and regionalism,legal globalization presents four development trends:transnational rule of law,local law under globalization,localization of global law,cosmopolitanism and common heritage of mankind.
