大数据时代图书馆著作权例外制度的挑战与重构

Challenges and Reconstruction of Library Copyright Exception System in Big Data Era

图书馆著作权例外制度需要保持著作权与公共利益的平衡。大数据时代带来的数字化阅读、图书馆数字化建设、著作权权利中心的变化,对著作权例外制度的适用范围、运行方式、鼓励图书馆自身创新、排除著作权实现障碍等方面均产生了一定冲击和挑战。笔者认为,重构大数据时代图书馆著作权例外制度,应坚持公共利益优先、鼓励创新、开放共享原则,采取设置原则性条款、扩大制度适用的读者对象与空间范围、鼓励使用共享与馆际互借、坚决破除著作权权利垄断、以技术手段严格保护著作权人的合法权利等具体制度安排。

Library copyright exception system needs to maintain the balance between copyright and public interest. The changes of electronic reading, library digitization and copyright rights center brought about by the big data era have a certain impact and challenge on the scope of application of copyright exception system, the mode of operation, the encouragement of library's own innovation, and the exclusion of copyright realization obstacles. Reconstructing the system of copyright exception of library in the era of big data, we should adhere to the principles of public interest priority, encouragement of innovation and open sharing, adopt the principle of setting principled clauses, expand the scope of readers and space applicable to the system, encourage the use of sharing and interlibrary loan, resolutely break down the monopoly of copyright rights, to strictly protect the legal rights of copyright owners by technical means and other specific institutional arrangements.
