基于交易特征的全过程工程咨询合同研究

Research on Whole Process Engineering Consulting Contract Based on Transaction Features

国内的全过程工程咨询尚处于试点阶段,缺乏成熟的合同范本。本文以全过程工程咨询的交易特征为切入点对合同关键条款展开研究,从多主体参与的权责界定问题、业主协调管控问题、集成化服务的过程监督问题、支付的前提条件及激励问题、争议评审问题几个方面提供政策建议。

The whole process engineering consulting in China is still in the pilot stage,without mature contract model.Based on the transaction features of it,this paper studies the contract key terms,and provides policy recommendation from several aspects,such as the definition of authority and responsibility,owner coordination and control,the process supervision of integrated service,the precondition and incentive of payment,and the review of disputes.
