关于医药用途发明新颖性审查的思考和建议

Thoughts and Suggestions on the Novelty Examination of Medical Use Inventions

随着我国天然药物化学领域研究的不断深入,天然药物的提取分离以及单体化合物的活性筛选越来越受到医药工作者的关注,由此近年来基于发现化学产品药学活性的医药用途专利的申请量也与日俱增。本文立足医药领域的现状,结合目前审查中涉及医药用途权利要求新颖性评价的案例对医药用途权利要求新颖性审查中关于确定权利要求保护范围、发明与发现的关系等方面进行探讨,对目前医药用途发明专利新颖性的审查标准提出了几点建议。

With the deepening of research in the field of natural medicinal chemistry in China,the extraction and separation of natural medicines and the screening of the activity of monomeric compounds have attracted more and more attention from medical workers.In recent years,the amount of applications for medical use patents based on the discovery of medicinal activity of chemical products is also increasing.Based on the current situation in the field of medicine,this paper discusses the protection scope of the claims,the relationship between inventions and discoveries during the novelty examination of medical use patents and several recommendations have been made on novelty examination standard for medical use inventions.
