专利说明书记载的技术问题具有主观性。但在创造性的“三步法”评价中,发明实际解决的技术问题客观反映了发明人认识和改造现有技术的内容,体现发明人对社会的贡献。在考虑区别特征的作用与效果时,在因果逻辑链条上,应当考虑到最后环节;在上下位概念上,应当从区别特征所在位置来考虑。

The technical problem described in the description has its subjectivity.However,in the assessment of the inventive steps of an invention by the"three-step approach",the technical problem actually solved by the invention objectively reflects the inventor's understanding on and reforming the contents of the prior arts,and also reflects his/her contributions to society.The final link in the causal logic chain should be considered when determining the role and effect of the distinguishing feature of an invention.And it should be determined what the distinguishing feature really means rather than ascribing it to an upper level term or a lower level term.
