浅谈专利审查中基于发明构思的创造性评判

Discussion the Judgment of the Inventive Step Based on Invention Conception in Patent Examination

本文从我国专利法评判创造性的“三步法”的第二步展开讨论,从剖析使用“三步法”进行创造性判断的原因和正确适用“三步法”两个方面,理论与实践相结合对创造性判断“三步法”的第二步进行了梳理,给出了在创造性评判“三步法”应用过程中,不仅要基于发明构思,合理拆分技术特征,还要准确比较得到区别技术特征,更重要的是要根据发明构思合理解读这些区别技术特征,明确它们在发明整体构思中的地位和作用,避免孤立、片面地看待人为拆分的技术特征,造成评判上的偏差。

Through analyzing both the origin of the inventive step judgment using the"three-step method"and application of the"three-step method"aspects,the second step of"three-step method"is sorted out,it is given that in the application of the"three-step method",not only reasonably splitting technical features and obtaining accurate distinguishing features based on the invention conception,but also reasonably understanding these distinguishing features and clearing their positions and roles in the overall inventive conception,to avoid the isolated and one-sided view of the technical features of artifi cial splitting,and to cause bias in judgment.
