论医师治疗权之权利义务统一性

The Unity of Rights and Obligations of Physician’s Right to Treatment

医师治疗权具有权利义务统一性,一般主要体现权利性属性,特定情况下,义务属性居于优势地位。本文试图寻找赋予医师治疗权权利属性转变为义务属性的法学、伦理学基础,并提出行使治疗权应以不得拒绝行使为原则,可以拒绝行使为例外,并且拒绝行使治疗权应受到严格限制,即法定不得拒诊、唯一可及下的应诊和拒诊后的适当照顾。在此基础上,对我国法律所规定的医师治疗权的内容及边界进行准确界定,以更好指导医疗实践中医师治疗权的履行。

The doctor’s right to treatment is the unity of rights and obligation. In general,it mainly embodies the attributes of right. Under some special circumstances,the attributes of obligation are in a dominant position. This article attempts to find the legal and ethical foundations for the transformation from right attributes to obligation attributes,and proposes that physicians are not allowed to give up treatment rights generally,but there are exceptions. The refusal to exercise the right to treatment should be strictly limited that compliance by the law,no abstention when irreplaceable,and proper care after refusal. Based on the above,this article accurately defines the content and boundaries of the right to treatment prescribed by the law for guiding the implementation of the doctor’s right to treatment in medical practice better.
