完善我国国有林场林地流转的法律制度研究

Study on Improving the Legal System of Woodland Circulation of the State-owned Forest Farms in China

现阶段我国国有林场林地流转的法律制度不完善,已成为制约国有林场林地流转的主要障碍。文章重点从国有林场林地流转范围、流转方式、受让方资格和条件、流转审批前必经的程序、流转审批制度、流转后的监管6个方面,来完善我国国有林场林地流转法律制度,争取在国家层面尽快出台国有林场林地流转管理办法,以此规范国有林场林地流转行为,推动国有林场林地有序流转,保护国有林场森林资源,促进我国国有林场事业可持续发展。

At present, the legal system of woodland circulation of the state owned forest farms in China has not been improved yet, which has become a major obstacle to restricting the woodland circulation of the state owned forest farms. This paper focused on the six aspects of state-owned forest farm *s woodland, namely, the scope of cir culation, the way of circulation, the qualifications and conditions of transferee, the procedures before circulation ap proval, the circulation approval system and the supervision after circulation, so as to improve the legal system of woodland circulation of the state-owned forest farms in China and promote the government to roll out manage ment on woodland circulation of the state-owned forest farms as soon as possible, to regulate the woodland circula tion, to promote the orderly woodland circulation, to protect forest resources and to promote the sustainable devel opment of the state owned forestry farms in China.
