摘要
非物质文化遗产不仅仅是一个国家文化的传承与展现,更是全世界人类在历史发展长河中共同凝结的智慧瑰宝,其地位与重要性可见一斑,但与之相对的,是从理论层面上,对于非物质文化遗产的知识产权保护的认知与践行,存在不相适配或冲突的地方。围绕非物质文化遗产的基本特征,对于其知识产权存在的权力基础、矛盾与冲突及两者结合的合理性展开理论性的探究与分析。
Intangible cultural heritage is not only the cultural inheritance and display of a nation,but also the condensed wisdom treasure by all human beings in the long history in the world,and its important status can be noticed evidently.However,theoretically,there is a disagreement or conflict between the cognition and practice of intellectual property protection regarding intangible cultural heritage.This paper,focusing on the basic characteristics of intangible cultural heritage,explores and analyzes the power basis,contradictions and conflicts of intellectual property rights as well as the combination rationality of the two.
