法律发现的演变——从立法到司法

Evolution of Legal Discovery: From Legislation to Justice

法律发现作为法律方法的开篇而逐渐受到国内学者的关注,但是追溯这个词源能发现其在西方的研究中更早的是出现在立法领域,最耳熟能详的莫过于萨维尼的“发现法律”。然而仔细梳理立法领域和司法领域内的法律发现研究,其间虽有共同但也存在本质的差异。因而在结合我国法治追求的时代环境下,将法律发现仅定义在司法领域内或许更能构建一种属于法律方法的法律发现体系,推动司法中心主义的研究和能动司法的进步。

As the beginning of legal method,legal discovery has gradually attracted the attention of domestic scholars,while tracing back to the etymology,we can find that it appeared earlier in the field of legislation in the western research,and the most familiar one is Savigny's "discovery law".However,a careful review of the research on Legal discoveries in the legislative and judicial fields shows that there are common but essential differences.Therefore,in the context of the pursuit of the rule of law in our country,defining legal discovery only in the judicial field may be better to construct a legal discovery system which belongs to the legal method,and promote the research of judicial centralism and the progress of active justice.
