摘要
中国目前没有对环境权作出具体规定,而对于环境公益诉讼的相关规定亦散见于部分不同层级的法律文件,具体内容尚不完善,也缺乏相应的权威性。尤其是能够提起诉讼的原告主体方面有待进一步充实,因而导致中国当下在环境公益诉讼司法实务方面存在着许多问题。应充分吸收地方实务中的检察机关诉讼和环保组织诉讼,借鉴发达国家公民诉讼等先进经验,构建起公民直接提起诉讼与公民诉权受阻时检察机关提起公益诉讼相结合的主体制度,同时完善环保组织和其他社会团体提起环境公益诉讼的补充性制度,构建适合于中国的环境公益诉讼体制。
There is no specific provisions on environmental rights in China,and the relevant provisions of environmental public interest litigation also scattered in many legal documents.The specific content is not perfect,but also lack Corresponding authority.Especially the plaintiff who can bring the lawsuit subject need to be further enriched,which lead to many problems in the current environmental public interest litigation judicial practice in our country.We should fully absorb the practice of innovation in local practice,learn from the advanced experience of developed countries.We will build a citizen directly brought the litigation,and the civil rights of the prosecution of public prosecution litigation combined with the main system,while improving the supplementary system for environmental protection organizations and other social groups to file environmental public interest litigation.We will build an environmental public interest litigation system suitable for China.
