随着现代医学技术的发展,死亡过程被人为延长,痛苦却丝毫没有减少。人们渴望舒适、安详、其有尊严的离世,却受到现实因素的制约。医学预嘱与医疗选择代理人的确定能够帮助患者家属理解并遵循患者的本人意愿。示范文本解决了现存医学预嘱内容过于简单、文字表述有歧义、存在默示同意内容等法律问题,规范了目前中国临床授权委托行为,以期起到保障患者权益的作用。

With the development of modern medical technology, the process of death has been prolonged artificially, but the pain has not been reduced at all. People yearn for a comfortable, peaceful and dignified death, but it is restricted by realistic factors. Living will and the determination of the medical selection agent can help patients’ families understand and follow their own wishes. This model text solved the existing legal problems such as simplicity of the content of medical advice, ambiguity in the expression of words and implied consent. It also standardized the current clinical authorization entrustment in China and played a role in protecting the rights and interests of patients.
