摘要
美国新一轮特别301调查对我国版权产业发展和版权国际贸易具有重要影响,美国所提出的版权问题集中于版权立法和执法领域,具体事由涉及影视作品版权保护、网络平台上侵权盗版处理和版权产业域外主体资格限制等多个方面。针对特别301报告中的版权问题,我国需结合当前版权立法和执法现状,明确自身在版权国际贸易中的市场地位并考察版权执法活动的实际效果,在谋求中美双方版权共同利益最大化的基础上完善相关法规政策并加强版权执法力度。
The new Special Section 301 Investigation initiated by the U.S. has a great influence on the development of copyright industry and international trade of copyright in China. The main disputes are in the field of copyright legislation a nd law enforcement. The specific issues involve the copyright protection of film and video works, the resolution of piracy and infringement on online platforms and the limitation of the foreign body of the participation in copyright industry. To respond to copyright issues in this special 301 investigation, it is necessary to combine the copyright legislation and law enforcement status in China, clarify China's market position in international copyright trade and examine the real effect of copyright enforcement activities, try to maximize the common interests in order to improve relevant laws and regulations and strengthen the copyright enforcement.
