政府购买体育社会组织公共服务的制度困境与契约治理研究

A research on the institutional dilemma and contractual governance of the government purchasing public service of social organization on sports

运用文献资料法分析了政府购买体育社会组织公共服务的制度困境与治理路径,结果表明:政府购买体育社会组织公共服务存在管制性制度困境、规范性制度困境与文化-认知制度困境。引入新制度经济学契约理论对政府购买体育社会组织公共服务的契约治理提出路径建议:从契约的平等性原则出发,扭转政社关系思维固式;从契约的自由性原则出发,培养市场"竞争性"与社会组织"独立性";从契约的过程性原则出发,健全过程监管与绩效评估体系;从契约的不完全性特性出发,完善法律法规并引入中介机构。

By using the method of document,this paper studies the institutional dilemma and governance path of the government purchasing public service of social organization on sports,the result shows that there are some dilemmas of regulatory institution,normative institution,and cultural- cognitive institution on the government purchase of public service of social organization on sports.The paper introduces contract theory of neoinstitutional economics to provide suggestions for the government purchasing public service of social organization on sports: reversing the thinking pattern of political-social relations according to equality of contract,fostering "competitiveness"of the market and"independence"of the social organization based on the freedom of contract, protecting the system of process supervision and performance evaluation on the basis of the process principle of contract,completing laws and regulations,as well as introducing intermediary organ from incompleteness of contract.
