摘要
在加快生态文明法治建设的今天,环境法治教育改革已逐渐步入正轨。环境司法通用教材编写是生态文明法治背景下环境法研究生教育中的一个重要课题,但目前环境法学界对此课题仅为提及但未集中探讨。有必要基于环境法学与教育学背景,从战略高度认识编写该教材的重大意义。编写该教材要明确参与人员、主要目标与现实路径。教材参编人员除有从事环境刑法、环境民法、环境行政法教学研究的资深教授外,还应包括环境资源审判庭的法官、环境资源法律团队的优秀律师、环保行政主管部门的负责人、主办环境资源类案件的检察官、中国环保公益组织代表等。教材编写以培养环境法研究生的司法理论水平与实务操作技能为目标,教材主要适用于环境法研究生教学,也可用于环境司法专业法官的理论与实务培训及环保案件律师业务培训。教材编写可走先开发地方试用教材等条件成熟时再编写全国教材的路径,同时兼顾实用性与研讨性、前沿性与现实性、稳定性与权威性,并以此为基础确定基本框架,进而有机充实相关理论、制度与实例。
Today,with the acceleration of the construction of the rule of law in ecological civilization,the reform of environmental law education has gradually entered the right track.The compilation of general textbooks of environmental justice is an important subject in the graduate education of environmental law against the background of ecological civilization and rule of law.However,at present,environmental law circles only mention this subject but have not done anything in focused research.Based on the background of environmental law and education,it is necessary to understand the significance of compiling the textbook from a strategic perspective.The compilation of the textbook should clarify the participants,the main objectives and the realistic path.In addition to senior professors engaged in the teaching and research of environmental criminal law,environmental civil law and environmental administrative law,the editors of textbooks should include judges of environmental resources tribunal,excellent lawyers of environmental resources legal team,leaders of environmental protection administrative departments,prosecutors sponsoring environmental resources cases,representatives of China’s environmental protection public welfare organizations,etc.The aim of compiling textbooks is to cultivate the judicial theory level and practical operation skills of graduate students of environmental law.Although textbooks are mainly suitable for graduate students of environmental law they can also be used for the theoretical and practical training of judges in environmental justice and the professional training of lawyers in environmental cases.The compilation of textbooks can take the path of developing local trial textbooks before compiling national textbooks when conditions are ripe.At the same time,the compilation should give consideration to practicality and discussion,frontier and reality,stability and authority,on the basis of which the basic framework can be formed,into which relative theories,systems and cases can be put.
