在当代中国,"坚持党的领导"与"党必须在宪法和法律范围内活动"合力构成了建设现代国家和法治中国的政治与法律基础。党内法治是经由纪检监察机制实施宪法统摄下的国家法律和党内法规制度体系所达致的善治状态。从其法理意涵、历史源流、制度基础、实施机制与法理价值诸多方面考察可知,党内法治具有法理正当性。通过富有成效地探索中国特色社会主义法治道路,党内法治回应了中国共产党寻求党内治理长效机制的理论期待,它有助于实质性地推进法治中国的实现,同时也有助于培育和发展法理思维。

In contemporary China, the combination of "adhering to the leadership of the Party" and "limiting the Party’ s activities within the constitutional and legal scope" constitute the political and legal basis for building a modern state and rule of law in China. The Rule by Regulations of Party is the state of good governance achieved by the enforcement of the dual system of the national laws and the regulations’ system of the Party under the guidance of the Constitution, which is implemented through discipline inspection and supervision. According to the aspects of its jurisprudential meaning, historical origin, institutional basis, implementation mechanism and jurisprudential value, the Rule by Regulations of Party is legitimate. The Rule by Regulations of Party responds to the theoretical expectation of the Party for seeking a long-term mechanism of intra-Party governance, helps to substantially promote the realization of the rule of law in China and nurtures the jurisprudential thinking, which is an active and effective exploration of the road to the rule of law under the socialism with Chinese characteristics.
