Orienting Social Work as Professional Assistant in Judicial Social Governance:A Case Study in Community Correction

厘清司法社会治理中社会工作的角色与定位,不仅关乎司法社会治理的法务实践与政策设计,同时也关系中国社会工作的本土化进程与专业化发展。本文以南海区社区矫正工作为例,具体阐述了基层司法社会治理的框架与模式,司法社会工作的角色困惑与定位冲突造成了司法社会工作服务的降格,在中国目前的国家治理模式和司法实践环境下,专业辅助者是司法社会工作最现实和有效的发展定位,是政策制定者、司法实践者和社会工作从业者开展工作的一个有效着力点。

The social governance of judicial issues is an academic issue that needs to be studied urgently,and it is also an important construction content of modern Chinese state governance. To clarify the role and orientation of social work in judicial social governance is not only related to the legal practice and policy design of judicial social governance,but also to the localization process and professional development of Chinese social work. This paper takes the community correction work in Nanhai District as an example,and elaborates the framework and model of grassroots judicial social governance. However,problems such as role confliction in practice and vague positioning of social work still occurs in judicial social governance,leading to the degraded service in judicial social work. We propose that under China’s current national governance model and judicial practice environment,professional assistant may be the most realistic and adequate orientation of judicial social work,and an effective focus for policy makers,judicial practitioners and social works.
