全球专利格局下的中国专利战略

Chinese Patent Strategy in the Context of Global Patent Pattern

自二十世纪末以来,发达国家以及新兴工业化国家开始致力于通过专利战略的调整来获取国际优势地位。经过各国之间不断地较量,“一超多强”的国际专利格局已基本形成,全球专利一体化的大趋势已不可逆转。当前,全球专利制度仍处于不断变化之中,专利合作、区域专利联盟的出现丰富了国际专利制度供给。与此同时,我国专利制度经历了从“舶来品”到“本土化”的过程,以专利战略促知识产权强国建设已成为内生需求。立足于全球专利格局及知识产权强国背景,我国可从专利战略的地域布局、国家和地区间合作计划、国内专利制度的优化、专利运用与成果转化的促进、综合实力及谈判能力的提升等角度出发,推进专利战略。

Since the end of the 20th century,developed and newly industrialized countries began to formulate patent strategy in order to gain international edge,which has resulted in the uni-multipolarity global pattern.The general trend of global patent integration is irreversible.Currently,the global patent system is still in constant change,and the emergence of patent cooperation and regional patent alliances have enriched the international patent system.At the same time,China’s patent system has gone through a process from legal transplants to localization.Given the global patent pattern and China’s goal to becoming an IP power,China can push forward its patent strategy from five perspectives,namely,regional layout,national and regional cooperation plan,domestic patent system optimization,commercialization of IP results,and improvement of comprehensive national capability and negotiation ability.
