The Origin of Intellectual Property and China’s Modernity

在西方先进工业文明的冲击之下,中国被卷入了世界现代性的历史大潮,由此开启了我国传统社会与传统法制现代性转型的艰难历程,即推动我国传统社会向着以个人权利等核心价值观为支撑的现代社会变迁,推动传统社会赖以存在的固有法统完成现代性法权制度及其义理价值的塑造。这就决定了作为非中华固有之制的知识产权法制,与中国现代性的起源基本同步,它从一开始就被现代性的表达与实践裹挟其中。在知识引进的大潮下,知识产权在观念启蒙、概念传播和制度移植等方面完成了文化基层建构,其目的是通过国家权力的强力支撑,自上而下地把知识产权法律规则植入中国社会,以创设一种迥异于中国传统发展方式的新的生产、生活和法治秩序,从而演绎了中国现代性建构的生动实践。

Under the impact of advanced western industrial civilization,China got involved in the historical tide of worldwide modernity,and started a tough course of modernizing traditional Chinese society and legal system,pushing China to transform from a traditional society to a modern society supported by the core values such as individual rights,and pushing the inherent legal system on which the traditional society existed to transform into a modern legal system.It shows that intellectual property system,as a foreign legal system,developed roughly the same time with the origin of Chinese modernity.It had the appearance of modern expression and practices from the very beginning.Against the backdrop of massive knowledge introduction,intellectual property completed the construction of cultural infrastructure in terms of idea enlightenment,concept distribution,and system transplantation.The purpose is to embed intellectual property law into Chinese society,from top to bottom,through strong support of state power,to create a new order of production,life and rule of law which is radically different from the traditional Chinese development modes.The course vividly re flects the practice of China’s modernity construction.
