《刑法》第二百一十七条“复制发行”的概念应随着技术和时代的发展而不断调整。首先,数字化时代的“复制发行”不应固守印刷术时代“有形载体”的要件;其次,应支持司法解释将“复制发行”理解为“复制、发行或者既复制又发行”的做法;最后,刑法解释具有独立性,将“信息网络传播行为”视为“复制发行”既是实践的需要,也没有超出国民预测可能性。
