摘要
“消费者无理由退货权”被视为新《消法》中的“明星条款”。正确适用无理由退货权,可从网购合同中无理由退货权的性质出发;考虑无理由退货权的商品范畴和经营者范围,以明确该权利实施的条件;消费者对“不宜退货”的商品应进行合理确认;经营者在订立格式条款时,必须通过必要的途径以尽到严格的提请注意义务;而且,应完善“商品完好”的判断标准以及确定“冷静期”。并在此基础上,应严格限制无理由退货权的行使,营造良好的消费环境。
“The right of consumers'returning goods without reason”is considered as“star clause”in the new Consumer Protection Law of the People's Republic of China.We can start from its nature in the online purchase contract to apply it correctly;And we can consider its product range and operator range to clarify the conditions under which the right is enforced;Consumers should reasonably confirm the goods that are“not suitable for return”;Operators must pass the necessary channels to achieve strict duty of care when concluding the format clauses;Moreover,we should improve the judgment criteria of“intact goods”and determine the“cooling-off period”.On these basis,we should strictly limit the exercise of the right to return goods without reason and create a good consumption environment.
