摘要
综述人工智能创作作品的现实、人工智能创作作品能否独立受法律保护之理论研究现状和域外人工智能创作作品的法律保护路径,发现人工智能在知识创作领域的应用已不可逆转、域外的人工智能创作作品法律保护路径有利于解决我国理论界对人工智能创作作品能否独立受法律保护存在争议的现实。基于此,在评鉴“首例人工智能(AI)生成内容著作权案”基础上,提出构建人工智能创作作品的“创作——收益”二元保护模式。
This paper reviews the reality of artificial intelligence creation, whether the artificial intelligence creation works can be independently protected by law, and the legal protection path of artificial intelligence creation works. It is found that the application of artificial intelligence in the field of knowledge creation is irreversible. The legal protection path of artificial intelligence creation is conducive to solving the reality that Chinese theoretical circles have disputes over whether artificial artificial creation works can be independently protected by law. Based on this and the evaluation of the "first artificial intelligence (AI) generated content copyright case", the author proposes the "creation-benefit" dual protection mode for constructing artificial intelligence creation works.
