The Influence of the Nature and Outlay of Consumer Association on Its Ability of Initiating Public Interest Litigation

消协半官方性质与经费对提起公益诉讼的有利之处:取证能力更强;不利之处:过度依赖政府拨款、公益诉讼资金申请耗时长,效率低、不利于工作组的建立及灵活开展工作。完善建议:提高消协独立性,扩充消协经费来源,尝试构建公私融合的公益诉讼模式,设立特别的报告制度,加快拨款速度、设立消费者公益诉讼基金、尽快建立专门的公益诉讼工作小组等。

The advantage of the semi-official nature and the outlay of the consumer association for public interest litigation mainly lie in better forensics, while its disadvantages lie in the over-reliance on government funding, the time-consuming and inefficient process in public interest litigation fund application, the difficulty of establishing groups and working flexibly.Our suggestions are : improving the independence on consumer associations, expanding their funding sources, trying to build a public interest litigation model of public-private integration, setting up a special reporting system, speeding up funds allocation and the establishment of consumer public interest litigation fund, and establishing pecial public interest litigation working group as soon as possible.
