VR式模拟法庭：对模拟法庭的一种社会学改良

VR moot court:a sociological improvement on moot court

模拟法庭被认为是法律职业训练的有效方式。然而,缘于法条中心主义范式,现实司法过程中的非法律技术因素均被从模拟法庭里剔除了。这种对司法现实的过度裁减,导致模拟法庭对司法现实的重度失真,失去了作为法律职业训练工具的有效性。针对传统模拟法庭模式,尝试设计出一种全新的VR(虚拟现实)式模拟法庭教学方案,把现实司法过程中普遍存在的各类非法律技术因素引入模拟法庭,以期实现对真实司法环境的高度仿真。

Moot courts are considered to be an effective way to train the legal profession.However,due to the paradigm of rule of law centralism,the non-legal technical factors in the real judicial process are removed from the moot court.This excessive reduction of judicial reality leads to the severe distortion of judicial reality by the moot court,which loses its effectiveness as a tool of legal vocational training.Aiming at the traditional model of moot court,this paper tries to design a brand new VR(virtual reality)model court teaching program,and introduces various non-legal technical factors commonly existed in the real judicial process into the mock court,so as to achieve a high degree of simulation of the real judicial environment.
