论生态环境损害的行政命令救济

On the Remedy for Eco-environmental Damage through an Executive Order

生态环境损害救济的技术性和公益性特点决定了行政命令救济能够在生态环境损害救济中发挥重要的功能。生态环境损害的几种典型救济路径各有其优点和不足,单独一种救济路径不能够对生态环境损害进行全方位和有效的救济,因此需要建构一个多路径并存的救济体系。在我国未来的多路径并存的生态环境损害救济体系中,应当确立行政命令救济在应急性救济、生态环境修复和非金钱替代性修复方面的主导地位。

The technological nature and public interest nature of the remedy for eco-environmental damage decide that the remedy through an executive order can play an important role in the remedy for eco-environmental damage. The existing typical remedial ways have their respective advantages and disadvantages and only one way cannot provide comprehensive and effective remedy for the eco-environmental damage,so it is necessary to establish a remedy system with multiple ways. In the future remedial system with multiple ways for the eco-environmental damage in China,the remedy through an executive order shall be made play the leading role in the emergency remedy,eco-environmental restoration and non-monetary alternative restoration.
