我国刑事速裁程序效率价值探究

Research on the efficiency value of criminal expedited procedure in China

作为一种刑事诉讼程序,速裁程序应该在遵循刑事诉讼法基本原则、充分保障当事人基本权利、确保司法公正的前提下,充分发挥和体现效率价值。速裁程序的效率价值主要体现在两个方面:一是速裁程序审结单个案件的快慢程度;二是速裁程序在所有刑事案件中被选择适用的比例。刑事速裁程序可以缓解近年来刑事案件增多的压力,对案件进行繁简分流,优化司法资源配置,与普通程序、简易程序一起构成我国完整的刑事审判程序的价值体系。重视刑事速裁程序的效率价值具有正当性和可行性。当务之急是使刑事速裁程序能够发挥它的效率价值,而非通过强调刑事诉讼的其他价值来压制其效率价值的发挥。

As a criminal procedure,the expedited procedure should fully exert and reflect the efficiency value under the premise of following the basic principles of the Criminal Procedure Law,fully protecting the basic rights of the parties and ensuring judicial justice.The efficiency value of the expedited procedure is mainly reflected in two aspects: one is the speed of the expedited procedure to conclude a single case;the other is the proportion of the expedited procedure selected in all criminal cases.The criminal expedited procedure can alleviate the pressure of increasing criminal cases in recent years,distinguish between complicated and simple cases,optimize the allocation of judicial resources,and constitute the value system of the complete criminal trial procedure in China together with ordinary procedures and summary procedures.It is justifiable and feasible to attach importance to the efficiency value of the criminal expedited procedure.It is imperative that the criminal expedited procedure be able to exert its efficiency value,rather than suppressing the efficiency value by emphasizing other values of criminal proceedings.
