网络诈骗犯罪及其遏制对策

Crime of Network Fraud and Its Containment Measures

当今互联网高速发展的同时,网络诈骗犯罪已成为犯罪的毒瘤之一。网络诈骗犯罪给社会带来了极大的危害,严重侵犯了人们的财产安全,破坏了社会秩序。现行刑法中有关网络诈骗犯罪的具体条文并不完善,如何定性、应对越来越多的网络诈骗案件,成为社会关注的话题。结合我国网络诈骗犯罪的现状,找出立法的不足,并对遏制网络诈骗犯罪提出一些对策。

In this era of rapid development of Internet culture,Internet fraud crime has become one of the cancer.Internet fraud crime has brought great harm to the society,gross violation of the safety of people and property,destroy the social order.Specific provisions in the existing crimes related to fraud in criminal law and there is no perfect,characterization,response to a growing number of Internet fraud cases,become a topic of public concern.This article introduces the concepts of cyber crime and Internet fraud,summed up the characteristics of online fraud and crime characteristics,combined with our present situation brief analysis of causes of Internet fraud crime,finally identified the shortcomings in legislation and practice,presents how to curb Internet fraud crime act recklessly and related recommendations.
