我国启动社区矫正的目的之一,就是要扩大非监禁刑罚适用、扩大假释的适用。然而,社区矫正实行15年来全国监狱假释适用率却仍然极其低下,在监狱、社区矫正执行一体化构建语境下,监狱警察派驻社区矫正可以整合司法行政系统刑罚执行资源,但需要解决监狱警察职权行使的空间地域限制问题。扩大假释适用率,需要监狱、人民法院、人民检察院和社区矫正机构等部门的互动衔接。

One of the purposes of community correction in China is to expand the application of non-imprisonment penalty and parole.After 15 years of implementation of community correction,the application rate of prison parole in China is still extremely low.In the context of the integration of prison and community correction implementation,the community correction of prison police can integrate the resources of penalty execution in the judicial administration system,but it needs to solve the spatial and regional limitations of the exercise of prison police powers.Expanding the application rate of parole requires the interaction of prisons,people’s courts,people’s procuratorates and community correction agencies.
