Research on the Principle of Informed Consent in Personal Information Protection——From the Perspective of Internet Finance

知情同意原则是信息主体对个人信息自治的重要工具,是限制信息业者进行信息活动的手段。知情是认知,是信息主体参与信息活动和了解信息流向的前提;同意是判断,是决定何种个人信息在何种范围内可被利用的授权。但大数据时代的到来,知情同意原则的适用面临困境,这并不意味着我们应彻底摒弃知情同意原则。反之,我们应在肯定知情同意原则的基础上,发挥其尊重信息主体意思自治、限制信息控制者权利的作用,同时配以制度设计和技术设计,完善知情同意原则的实践路径。

The principle of informed consent is an important tool for information subjects to exercise autonomy over personal information,and it is also a means to restrict information providers from carrying out information activities.Knowledge is cognition,which is the premise for information subjects to participate in information activities and understand the flow of information.Consent is judgment and authorization to decide which personal information can be used in which scope.However,with the advent of the big data era,the application of informed consent principle is facing difficulties,which does not mean that we should completely abandon the principle of informed consent.On the contrary,on the basis of affirming the principle of informed consent,we should give full play to its function of respecting the autonomy of the information subject and restricting the rights of the information controller,and at the same time complement it with system design and technical design to perfect the practical path of the principle of informed consent.
