以行政机关为对象的行政案件执行难问题研究

The Study on Difficult Enforcement in Administrative Cases Targeting Administrative Organs

执行难一直都是我国司法实践中难以解决的问题,尤以行政机关作为被执行对象时更甚。文章通过对我国行政机关败诉案件执行情况加以分析,指出导致该问题产生的原因。同时借鉴域内外国家和地区的立法经验,从行政司法体制配置以及执行立法等方面提出解决行政机关败诉案件执行问题时可供参考的相关路径。

Difficult enforcement has always existed in judicial practice, especially when the parties subject to enforcement are administrative organs. The author analyzed the implementation status of cases in which administrative organs lost the lawsuit and explored the reasons of difficult enforcement. Drawing on the legislative experience of countries and regions at home and abroad, the paper proposed relevant solutions from the aspects of administrative judicature system allocation and legislation execution to help with enforcement of cases in which administrative organs lost a lawsuit.
