体育赛事版权研究的演化逻辑分析

On the Evolution of the Research into the Copyright to Sports Events

应用文献资料法、统计分析法、量化可视化分析工具以及法学、无形资产学、传媒经济学等方法和理论,在检索国内数据库的基础上,对二十多年来具有代表性的体育赛事版权相关研究成果进行梳理和分析,从而探究学术界对该领域研究的内在原因和演化逻辑。结果表明:体育赛事版权研究源于对体育赛事电视转播权经营中的法律保护问题研究;并大致经历了“体育赛事版权研究初步探索时期;体育赛事版权研究百的家争鸣时期;体育赛事版权研究的成熟时期”三个阶段。其演化的逻辑路径是“权力型无形资产—知识产权(版权)”。截至目前,该领域的研究大多都以“赛事转播(或直播节目)”为研究的切入点,尚未涉及与体育赛事密切相关的吉祥物设计图案、图片和文字等相关的版权问题。

By applying documentation method,statistical analysis and the visual quantitative analysis tool and so on,the domestic representative research achievements from the database which are related to the copyrights to sports events for more than 20 years are sorted out and analyzed on the basis of the theories of law,management,intangible assets and media economics in order to explore the evolution logic.The result shows that the study on Legal protection of marketing of TV broadcasting right to sports events gives birth to the copyright to sports events.And the research into the copyright has?experienced?three?periods and the logical path of its evolvement is from power type intangible assets to intellectual property.So far the study on the copyright to sports events is not concerned with the topics on copyright to patterns,pictures and words closely?related?to sports events.Based on the review and analysis,the future of the domestic research into the media copyright to sports events is prospected.
