走向敏捷治理:新兴产业发展与监管模式探究

Toward Agile Governance:The Pattern of Emerging Industry Development and Regulation

新兴产业在中国发展迅猛,却不可避免带来治理难题,成为当前国家治理面临的重要议题。具有高度不确定性的新兴产业,在产业路径、风险收益和市场信心方面都时刻面临变化,这为政府产业治理的目标和内容的设定带来了新困扰,挑战了传统政府监管政策的制定节奏和规则运行的适用性。针对新兴产业发展的特性,产业治理需要重新考虑法律假设,风险研判和利益平衡等三个维度问题,并建立以敏捷为核心的治理框架。本文指出,针对新兴产业的敏捷治理的核心是匹配产业发展所需要的制度资源,应在治理原则、治理关系和治理工具上有别于传统治理框架,从而实现治理核心目标的有机平衡。同时,在敏捷治理思想的引导下,新兴产业应在治理框架的灵活性和全面性上进行持续建设。最后,本文提出新兴产业走向敏捷治理的三条优化路径与措施。

Emerging industry develops rapidly in China. However, it inevitably brings governance difficulties and becomes an important issue facing the current national governance. With a high degree of uncertainty, emerging industry is always facing changes in their industrial paths, risk returns and market confidence, which not only brings metabolic troubles to the goal and content of governmental industrial governance, but also challenges the applicability of traditional governmental regulatory policies and rules. In view of the developmental characteristics of emerging industry, legal assumptions, risk assessment and interest balance are three dimensions that needed to be reconsidered in industrial governance to establish a governance framework with agile at its core. This paper points out the core of agile governance for emerging industry is to match the institutional resources with the development of the industry, which should be different from the traditional governance framework in governance principles, governance relations and governance tools, so as to achieve the organic balance of the core objectives of governance. At the same time, under the guidance of agile governance, emerging industry should continue to build on the flexibility and comprehensiveness of the governance framework. Finally, this paper raises three optimized paths for emerging industries to move towards agile governance.
