On Transplantation and Innovation in China’s Civil Law

我国民法作为典型的法律移植产物,其在民法理念、民事立法和民事司法等方面对域外民法进行了广泛的移植,在移植过程中,结合我国各历史阶段的发展背景呈现不同的移植姿态和特点,在总结移植经验的基础上,对民法的具体制度进行分析,找寻其中的移植内容与制度创新。

The Civil Law of China,as a typical product of legal transplantation,has carried out extensive transplantation of foreign Civil Law in the aspects of concept,civil legislation and civil justice.Combined with the different transplant posture and characteristics in development background of each historical stage of our country,on the basis of summing up the transplant experience,this paper analyzes the concrete system of civil law,and looks for the transplant content and system innovation.
