Chinese Civil Law’s Evolution in Seventy Years:Forming Civil Society with Characteristics of Freedom and Equality in Systematization and Scientization

中华人民共和国成立至改革开放的三十年是民法迷失的三十年,高度集中的计划经济摧毁了民法存在和发展的基础。改革开放至1993年选择市场经济体制,经济体制和社会在探索中向市场经济转型,民法快速发展,体系初步形成,民法理论获得重生和发展。市场经济体制确立后,社会观念进一步革新,民法制度日臻完备,基本实现民法的体系化、科学化。民法典编纂预计将在2020年完成,其后民法将继续发展完善。改革开放四十年,在观念不断革新、民法不断发展完善中,通过平等保护财产权、保护人格权和人格尊严以及在此基础上的意思自由决定并尊重社会伦理和秩序的民法制度,形成并塑造了一个不断发展并终将成熟的现代社会。

Chinese civil law lost its thirty years from the establishment of PRC to 1978, the beginning of reform and opening-up, because highly-centralized planned economy system destroyed the foundation of civil law. During the period of 1978 and 1993, the economy system gradually turned to a market economy system, and accordingly, Chinese civil law achieved fast development, including primary formation in system and revival and promotion in theory. After the final decision to a market economy system was made in 1993, Chinese civil law experienced a tremendous progress in twenty-six years. Together with a further reformation in ideas, Chinese civil law system has been approaching systematized & scientized. The Chinese Civil Code is expected to be formulated in 2020, and Chinese civil law will continue to develop hereafter. By now, the forty year’s reform and opening-up policy lead to continuous reformation in ideas and continuous advancements in Chinese civil law, which is fostering and shaping a modern civil society from its birth to evolution, with characteristics of freedom and equality.
