摘要
从浙江“宁海36条”的制度创新实践出发,基于制度创新的内部过程,文章讨论制度创新的有效性基础和基层治理现代化的实现路径。制度创新不仅是地方政府的内部决策,而且需要经过制度动员并最终落实到基层社会之中。利益密集不仅形塑了“规则之治”的制度创新方向,而且为复杂制度的嵌入和运行提供了动力和支撑。制度创新中的群众路线不仅是制度的文本形式与实践内容统一的基础,而且赋予制度创新过程以开放性,以适应复杂多变的治理形势。“宁海36条”代表了利益密集型地区基层治理现代化的实践探索,在制度推广过程中,须立足乡村治理的社会基础,避免制度创新中的形式主义。
Based on the innovation practice of “Ninghai 36 Rules”,?through the internal process of system innovation, we discussed the effectiveness foundation of the system innovation and the realizing route of rural governance modernization. System innovation is not only an internal decision of local government, but also a process system from mobilization to taking rooted in grass-roots society. Intensive interests shape the innovation direction of “Rule of Provisions”, and provide the motivation and support for the embedding and running of the complex system. The mass line in system innovation lay solid foundations for?the unification of text and practice.“Ninghai 36 Rules” represents the intensive interests areas at the rural governance modernization exploratory practice, if blindly promotion, may lead to system innovation of formalism.
