摘要
网络游戏直播是我国当前发展最为迅猛的文化产业新业态,但未经许可直播网络游戏属于侵权行为还是合理使用在理论和实务中均有争议。游戏动态画面是吸引网络用户在线观看直播的主要原因,游戏直播市场属于游戏画面权利人的预期市场。在认定网络游戏直播是否构成合理使用时,不宜直接将美国版权法上的四要素标准和国际公约中的三步检测法作为我国司法实践中审理具体案件的适用依据。基于解释论立场,网络游戏直播不属于合理使用,这一结论也可依据四要素标准从学理上得以检验。
Online game livestreaming is a new type of business in China’s cultural industry with the most rapid development. However, it is controversial in theory and practice whether it is a tort or a fair use to broadcast others’ online games without permission. The game dynamic screen is the main reason to attract users to watch the live broadcast online, and the game live broadcast market should belong to the expected market of game image owners. When determining whether online game live broadcast constitutes a fair use, it is not appropriate to directly take the four-element standard of us copyright law and the three-step test method in international conventions as the applicable basis for hearing specific cases in China’s judicial practice. In China’s current legislation, online game live broadcast is not a fair use, and this conclusion can also be verified theoretically according to the standard of four elements.
