摘要
发展绿色技术、共同应对全球气候非正常变化,是世界各国的共同需求。绿色低碳技术国际合作因其参与主体的多层次以及多元化特征,导致知识产权问题错综复杂,知识产权风险迫切需要得到治理。文章以中欧煤炭技术近零排放合作项目(NZEC)为例,在分析绿色技术国际合作知识产权治理驱动因素的基础上,对知识产权治理进行结构功能分析。通过适应功能、目标达成功能、整合功能和维持功能4个方面的分析和解读,认为绿色技术国际合作中的知识产权治理应从"管理-控制"转变为协商手段。有效知识产权治理目标的达成,需要通过法律协调、契约规制、利益机制构建来实现。
The development of green technologies and common responses to the abnormal changes in the global climate are the common needs of all countries in the world. Because of the multi-level and diversified characteristics of its participation subjects, the international cooperation of green and low carbon technology leads to the complexity of intellectual property rights, and the risk of intellectual property rights is urgently needed to be controlled. Taking NIEC as an exemples, based on the analysis of the driving factors of intellectual property rights governance in green technology international cooperation, this paper analyzed the structure and function of intellectual property governance. Through the analysis and interpretation of four aspects of adaptation function, goal achievement, integration function and maintenance function, it was considered that intellectual property governance in green technology international cooperation should be transformed from"management-control"to negotiation. The goal of effective intellectual property management should be achieved through legal coordination, contract regulation and interest mechanism construction.
