新时期商业银行监管框架重构研究——基于监管者与被监管者共同的价值观理念设计

监管与被监管之间的关系常以对立或共谋来形容,但大多数情况下是以对立形式出现。然而,在监管成本不断提高、监管体系不断完善、监管方法不断更新的同时,违规违法行为并没有减少,甚至在有些方面出现恶化。由此,不能不让人反思现有监管框架存在的不足。在强烈的商业化背景下,单靠重处重罚规范经营者行为还远远不够,本文从企业价值观管理的原理和作用逻辑出发,将价值观管理理念引入银行监管新框架的建构过程,结合现有银行监管体系的结构主体特征,从价值观的确立、传播和内化三个主要层次来开展银行监管价值观的管理工作。以共同的价值观可以将监管者与被监管者约束在同一起跑线上,实现同频共振,以共同的价值观构建新的监管框架是当前提高监管效率,探索监管改革,规范市场行为的有效手段与方法。

The relationship between the supervising and the supervised is often described in opposition or collusion, but in most cases it takes the form of antagonism. However,while the cost of supervision is rising,the supervision system is constantly improving,and the supervision methods are constantly updated,violations of the law have not been reduced,or even worsen in some ways.As a result,people can not help but reflect on the shortcomings of the existing supervision framework.In the context of strong commercialization,it is far from enough to rely on heavy punishment to regulate the behavior of operators.Based on the principle and function logic of enterprise value management, this paper introduces the concept of value management into the construction process of the new framework of bank supervision,combined with the structural main body characteristics of the existing bank supervision system, and carries out the management of bank supervision values from three main levels: the establishment,dissemination and Internalization of values.It is an effective means to improve supervision efficiency,explore supervision reform and standardize market behavior to construct a new supervision framework with common values,which can bind regulators and the regulated to the same starting line and realize the same frequency resonance.
