中国共产党领导地位在我国建国以来的历部宪法文本中发生了表述上的细微变化,尤其是改革开放的新时期以来,1978年宪法和1982年宪法又分别对中国共产党的宪法地位有了新的描述。2018年,中国共产党的领导地位又被宪法“再正文化”。中国共产党领导地位的宪法“再正文化”,是“坚持四项基本原则”在新时代的重要表现,是深化党和国家机构改革的组织保证,是宪法作为国家根本法在各方面属性的全面体现。中国共产党领导宪法地位需要在现实中得到进一步推演,党的指导思想与宪法指导思想的一致化、党的领导具体落实机制的可操作化、党的领导与治国理政体系和能力的现代化、“党管干部”形式与实质的统一化、党领导立法与地方性法规宪法地位的推广化、党政任期制顶层设计的一体化以及宪法监督机构和实施保障的强化,都将成为下一步中国共产党领导宪法地位现实推演的重要支撑和保证。党的领导地位的宪法表述的升华,也成为党依宪治国、依宪执政、提升法治思维的重要基础与源泉。

The leadership of the Communist Party of China has undergone minor changes in its expression in all previous constitutions since the founding of PRC,especially since the new period of reform and opening up.The 1978 Constitution and the 1982 Constitution respectively give a new description of the constitutional status of the Communist Party of China.In 2018,the leadership of the Communist Party of China has undergone"reappearance in constitution text"by the Constitution.The"reappearance in constitution text"of the CPC's leading status is an important manifestation of"adhering to the Four Basic Principles"in the new era,an organizational guarantee for deepening the reform of the Party and state institutions,and an overall reflection of the constitution as a fundamental law of the state in all aspects.The constitutional leadership of the Communist Party of China needs to be further deduced in reality.The consistency between the guiding ideology of the Party and the guiding ideology of the Constitution,the operability of the concrete implementation mechanism of the Party's leadership,the modernization of the Party's leadership and governing system and ability,the unification of the form and essence of"Party's managing cadres",the extension of the constitutional status of the Party's leading legislation and local laws and regulations,the integration of the top-level design of tenure system and the strengthening of the constitutional supervisory organs and implementation guarantees will be the important support and guarantee for the realistic deduction of the CPC's leading constitutional status in the next step.The sublimation of the constitutional expression of the Party's leadership has also become an important foundation and source of the Party's thinking of governing the country according to the Constitution,governing the country according to the Constitution and promoting thoughts on the rule of law.
