社会热点问题反思对培养法科学生法律思维能力的作用探讨

摘要 随着我国法治环境建设的不断推进,公众对重大案件司法裁判的关注度逐渐提高,有些案件甚至最终演变为社会热点问题,引发大范围舆论探讨.在这一大背景下,笔者就社会热点问题反思对法科学生法律思维能力的作用提出思考.现状显示,部分法科学生法律思维能力存在法律知识了解不够、法律逻辑构建模糊、法律情感有所欠缺等不足之处,而从优化法律思维能力的视角来看,社会热点问题的反思可以弥补高校法学教学局限性、强化对法学方法论的培养、重塑法学生的法律价值观,并最终导向法科学生职业素养的良性发展与法治环境的进一步优化. With the continuous progress of the construction of legal environment in China, the public pay more and more attention to the judicial adjudication of major cases. Some cases even turn into hot social issues and trigger a wide range of public discussions. Under this background, the author puts forward her reflection on the role of legal thinking ability of law students on social hot issues. The current situation shows, some law students have some deficiencies in their legal thinking ability,that is, their understanding of legal knowledge is not inadequate,their construction of legal logic is not clear, and their legal sentiment is lacking. From the perspective of optimizing legal thinking ability, reflection on social hot issues can make up for the limitations of law teaching in colleges and universities, strengthen the cultivation of law methodology, reshape the legal values of law students. Finally, it leads to the benign development of the professional quality of law students and further optimization of the legal environment.
